US Judge Orders Freedom of Abrego Garcia from Immigration Detention

A federal judge has ordered the immediate release of Kilmar Abrego Garcia from immigration custody, concluding his continued detainment is without lawful basis.

"Since his return from wrongful imprisonment in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis wrote in her order.

The case stems from a mistaken deportation to El Salvador earlier this year, which US authorities later admitted was an error. Following his return to the United States to face human smuggling charges, he was held in immigration detention.

In her order, the judge noted that the government does not have a current removal order, which prevents them from deporting Mr. Abrego Garcia "at this time."

Context of the Legal Challenge

The court proceedings involve disputed assertions. Whereas the Trump administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently denies this claim.

He has also pleaded not guilty to the smuggling counts, which are part of a ongoing trial in Tennessee.

The court, who was hearing his petition to removal in a federal court, ruled that he must now comply with the conditions of his release from custody in Tennessee. This order shifts his monitoring to the Tennessee court.
